§ 1: General provisions
- These Terms and Conditions define the rules for making purchases and using services electronically as part of the service available on the website https://decofabrix. com (“DECOFABRIX”).
- The administrator is SUPRAPRINT Kwiatkowski Sp. x o. o., registered in Pruszków, 5 Domaniewska Str., entered into the National Court Register under number 0001110165, Tax Identification Number: PL5271005265.
- The Terms and Conditions define the terms and conditions of use of the DECOFABRIX Online Store, as well as the scope of responsibility.
- By using the services of the DECOFABRIX Online Store, the user confirms that he has read the Terms and Conditions and accepts all its provisions, also committing himself to comply with its provisions.
- All contractual relations between DECOFABRIX and customers are subject to the General Terms and Conditions. Any deviations shall only be considered if they have been previously confirmed between DECOFABRIX and the customer in writing or have been expressly stated in these General Terms and Conditions.
- The Customer undertakes to provide complete and truthful information in the order form. Providing false data will result in the Customer being liable for the resulting damage.
- In matters not regulated in the Regulations, in particular for the submission of declarations of will in electronic form, the provisions of the Civil Code shall be applied.
§ 2: Conclusion of the contract
- Images and any other products presented by DECOFABRIX on the Internet or in other media are not an offer within the meaning of Article 534 of the Civil Code, but only an invitation to the customer to present a purchase offer. Purchase offers can be submitted via online order forms prepared by DECOFABRIX.
- The order placed by the Customer constitutes the conclusion of a purchase and sale agreement and is carried out on the basis of the applicable Regulations. Each ordered item must be configured by the Customer according to his wishes. You should familiarize yourself with all the configuration options and take into account the total price. All prices are always with tax and without shipping costs.
- The offered articles are only sample themes. The customer does not receive the original image, but only a copy prepared on the chosen medium and according to the chosen technique.
- After placing an order, the Customer is sent an e-mail with a summary of his purchases. The start of the order execution period shall be the next working day after the date on which the payment was accepted or booked.
- DECOFABRIX reserves the right to refuse to perform the service and fulfill the order if the products contain content contrary to the law, good manners or rules of social coexistence. The Store also reserves the right to make changes in the prices of goods on offer, as well as to changes in the cost of delivery of ordered goods.
§ 3: Available payment methods
- Electronic payment in the online payment system via the PayPal platform.
- Prepayment by bank transfer to the account number specified in the order summary.
- Cash on delivery upon receipt of the parcel with the order.
- Deferred payment for budget units.
- The payment is considered to have been made after the payment has been credited to the account. Placing an order and booking of payment is confirmed via e-mail.
§ 4: Delivery conditions
- The ordered items are sent to the customer via a courier company.
- Personal collection is possible at: DECOFABRIX, 5 Domaniewska Str., 05-800 Pruszków, Mon-Fri from 9:00 to 17:00.
- Each product from the store has an approximate lead time. This date is estimated and due to production factors is not guaranteed. It is calculated from the moment the payment is credited to our account. Orders with different lead times are sent after completion of the whole order, i. e. after the longest time of the given. In justified cases, the store reserves the right to send each product as a separate shipment.
- Delivery costs are calculated for each order and appear in the Configurator as the final price. The cost of delivery is charged to each order regardless of the form of delivery.
- In the event of delivery of goods not in accordance with the provisions of the contract arising from our fault, the customer undertakes to grant us an additional period of 2 weeks for the execution of the order.
§ 5: Damage caused during transport
- The buyer should check the condition of the parcel at the time of its receipt from the courier. If you find that the contents are damaged or have signs of opening, do not acknowledge receipt of the parcel, but ask the courier to draw up a damage report.
- The customer is obliged to inform the store as soon as possible about the attempted delivery of the damaged shipment.
§ 6: Limitation of liability
- DECOFABRIX is not responsible for the lack of permanent access to the Online Store and the speed of system operation, as well as technical and electronic errors occurring when placing an order, if their cause are factors beyond the store's control.
§ 7: Dimensional tolerance
- For printed fabrics and knitted fabrics, the dimensional tolerance is approximately +/- 2%.
§ 8: Color compatibility
- Due to the CMYK color palette used in production, please remember that many colors displayed on monitors will differ from those printed in reality. This especially applies to files:
A. In RGB mode,
B. Containing additional Pantone or RAL colours,
C. Containing metallic colors (gold, silver, chrome),
D. Containing fluorescent colors,
E. All standards listed above will be achieved by converting to the CMYK ink palette to achieve the closest similar color, but there is no guarantee that it will be identical.
§ 9: Design visualizations
- The pattern visualizer is a decoration proposal and is for illustrative purposes only.
- Due to the scale and the inability to assess all parameters on the monitor, the product visualizer does not reflect 100% compliance.
- Discrepancies may concern:
A. Colours,
B. Pattern details,
C. Size and proportion,
D. Transparency,
E. Method of finishing.
§ 10: Care
- Printed fabrics can be subjected to appropriate care, but special attention should be paid to the type of product ordered.
- It should be taken into account that textile decorations will tend to shrink depending on the washing temperature.
- Recommended care method: can be washed at low temperatures using mild detergents.
§ 11: Right to withdraw from the terms of the contract
- DECOFABRIX is a service for printing personalized fabrics on request. The customer himself determines the parameters of the order by initially selecting the photo, material, print size, up to the selection of possible product finishing options. Production is carried out from scratch according to specific features at the customer's request. Apart from the exceptions described in detail in Art. 8 on the terms of complaints. The customer has no possibility to withdraw from the contract.
- Due to the above, the right to withdraw from the contract pursuant to Article 7(1) (i.e. return of goods within 10 days without giving a reason) is definitely not available in the case of the following contracts:
A. Production of personalized products whose features were defined by the Customer in the order or serve to meet his individual requirements,
B. Production of products that, based on the order placed, become inextricably linked with other items, taking into account their characteristic features,
C. Concerning the delivery of goods that have been prepared and manufactured at the customer's special request, including photo wallpapers, paintings, posters, panels and other products available in the DECOFABRIX store,
D. Regarding goods that have been ordered and will be used for the Customer's business purposes.
§ 12: Complaints and returns
- DECOFABRIX provides a 12-month warranty for the purchased goods, which is valid from the date of delivery of the product to the Customer.
- Slight differences between the delivered product and the one offered in the store cannot constitute grounds for a complaint. Minor deviations are considered to be minor differences in the size, type and quality of the substrate, which are technologically unavoidable in the production process. Differences in the color of the actual product from the color of the product reproduced on the computer monitor cannot be the basis for a complaint. The color reservation applies especially to metallic and fluorescent colors and colors that go beyond the CMYK table. The store will also not accept complaints in the event of improper handling of the product by the Customer or improper installation.
- The Seller is liable to the buyer (customer) if the sold item has a defect that reduces its value or usefulness, if the item does not have the properties of which the store assured the Customer, or if the item was delivered to the Customer incomplete. In such a case, the Customer may demand that the product be brought to the condition consistent with the contract by free repair or replacement with a new product.
- Complaints are accepted if the Customer reports in writing (by e-mail or traditional mail) a noticeable defect of the goods or an incorrect delivery within 2 weeks from the date of delivery of the goods.
- If DECOFABRIX delivers a defect-free item as a complement to the delivery, it may demand the return of the defective goods from the Customer.
§ 13: Withdrawal from the terms of the contract by the seller
- DECOFABRIX reserves the right to withdraw from the terms of the contract without the Customer being able to claim damages within 7 days from its conclusion in the event of circumstances beyond DECOFABRIX's control that could not be predicted. The basis for withdrawal within the specified period is also interference in the structure of the store by third parties, as a result of which the functionality, website parameters, ordering mechanism and prices have changed.
- DECOFABRIX reserves the right to refrain from implementing:
A. Orders violating the personal rights of third parties,
B. Orders containing any form of violence, profanation, pornography or content contrary to applicable legislation and generally accepted standards.
§ 14: Copyright
- The purchase of goods does not constitute the acquisition of any copyright or other intellectual property rights to the purchased products.
- The products sold by DECOFABRIX are subject to worldwide copyright. The customer or third parties are not authorized to produce, distribute or reproduce DECOFABRIX products.
§ 15: Personal data
- By registering in the online store, the customer also consents to the processing of his personal data to the extent necessary to perform the concluded contract.
- The Customer's personal data provided are protected in accordance with the Act of August 29, 1997. about personal data protection. DECOFABRIX will make every effort to minimize the possibility of unauthorized access to this information by third parties.
- Personal data is not made available to other entities for marketing purposes.
§ 16: Final provisions
- In matters not regulated by these Regulations, the provisions of the Civil Code or other legal regulations relating to the operation of websites and online stores shall apply.
